IL CASO SANTO DOMINGO DI FRONTE ALLA CORTE INTER-AMERICANA DEI DIRITTI DELL'UOMO

This dissertation aims to comment and analyze the judgment of the Inter-American Court of Human Rights on the Case of Santo Domingo Massacre v. Colombia. The main purpose is to show the relevance that International Humanitarian Law has played on the Court's decisions, especially regarding this case, as well as to underline the positive impact carried out by the Court's active work on the Reconciliation process between The State and the revolutionary groups that still subsist in Colombia. Lastly, this thesis also aims to understand if the decision reached by the Court had led to a proper protection of Human Rights and if it had become a binding precedent for the protection of Fundamental human rights.

Questa Tesi si propone di commentare e analizzare la Sentenza Santo Domingo vs. lo Stato della Colombia. L'obiettivo principale è di mostrare la rilevanza che ha avuto il Diritto Internazionale Umanitario nella decisione della C.I.D.U. sul caso in analisi, nonché di evidenziare l'impatto positivo del lavoro della Corte nel recente processo di Riconciliazione tra lo Stato e i gruppi rivoluzionari presenti nel Paese. In ultimo questo lavoro si propone di comprendere se, nella decisione raggiunta dalla Corte, si sia verificata una corretta protezione dei Diritti Umani e si sia costituito un precedente vincolante nella protezione dei Diritti Fondamentali dell'uomo.
