Blockchain e Smart Contracts: un'analisi giuridica

In this paper i aim to analyze the phenomenon of Blockchain and Smart Contracts, a tool based on the same technology, from a legal point of view. the script is divided into three parts: The first chapter, more technical than legal, in which i try to provide the tools necessary to fully understand the phenomenon. The second part, focuses more on the legal aspects of the Blockchain technology itself, which examines the various approaches that the institutions have adopted towards this technology and the risks associated with it. A third chapter that analyzes Smart Contracts, the advantages they can give compared to traditional contracts and the critical issues they present. From this discussion it is clear that, although this matter has aroused the interest of national legislators and others institutions, the topic is still too early to give rise to a common and shared opinion. The approaches that can be held, however, to face the advent of this technology, are many and their greater use will also make it clearer what will be the evolution of the blockchain in the future.

In questo elaborato ci si pone l'obiettivo di analizzare il fenomeno della Blockchain e degli Smart Contracts (strumento basato su questa tecnologia) da un punto di vista giuridico. lo scritto si suddivide in tre parti: un primo capitolo, più di carattere tecnico che giuridico, in cui si cerca di fornire gli strumenti necessari per comprendere appieno il fenomeno. Una seconda parte maggiormente incentrata sugli aspetti giuridici della tecnologia Blockchain, in cui vengono esaminati i vari approcci che le diverse istituzioni hanno adottato nei confronti di questa tecnologia e i rischi ad essa collegati. Infine, nel terzo capitolo, vengono analizzati gli Smart Contracts, i vantaggi che questi possono garantire rispetto ai contratti tradizionali e le criticità che presentano. Da questa trattazione risulta chiaro che, benché questa materia abbia suscitato l'interesse dei legislatori nazionali e non solo, questa è ancora troppo poco diffusa per poter dare origine ad un parere comune e condiviso. Gli approcci che però possono essere seguiti per affrontare l'avvento di questa tecnologia sono molteplici ed un loro maggiore utilizzo renderà anche più chiaro quale sarà l'evoluzione della Blockchain nel futuro.
