I DIRITTI DEL BAMBINO MALTRATTATO

The aim of this thesis paper is mainly to analyze and explain how the Italian Constitution safeguards and protects the rights of the child, especially the rights of the abused child. In the first two chapters, in fact, after a brief explanation of what is mistreatment and who is the abused child, the focus will be on articles 2, 3, 30, 31, 33, 34 and 37, also referring to some judgments of the Constitutional Court related to these. In the last chapter, however, the attention will be shifted on the abused child mainly from the point of view of developmental psychology and criminal law, to give a more complete look on the subject. The paper will then close with a brief conclusion that will retrace the thesis work and summarize what was said in the three previous chapters.

L’obiettivo di questo elaborato di tesi è principalmente quello di analizzare e spiegare in che modo la Costituzione italiana salvaguarda e tutela di diritti del bambino, in particolar modo i diritti del bambino maltrattato. Nei primi due capitoli, infatti, dopo una breve spiegazione di che cosa sia il maltrattamento e chi sia il bambino maltrattato, sono trattati gli articoli 2, 3, 30, 31, 33, 34 e 37facendo anche riferimenti ad alcune sentenze della Corte Costituzionale inerenti a questi. Nell’ultimo capitolo, invece, si focalizza l’attenzione sul minore maltrattato principalmente dal punto di vista della psicologia dello sviluppo e del diritto penale, per dare uno sguardo piú completo sull’argomento. L’elaborato si chiude poi con una breve conclusione per trarre le somme del lavoro di tesi e sintetizzare quanto detto nei tre capitoli precedenti.
