Responsabilità nei contratti in palestra: un'analisi economica e giuridica

This dissertation aims mainly at analysing the gym membership contract with a particular focus not only on the legal liabilities that could arise, but also offering an introductive economic perspective on the gym activities. The analysis has been done by both analysing the Italian Civil Code and by looking at the specific court cases regarding this theme. The introductory economic overview has been conducted by using primary and secondary sources and data from gyms in Turin in order to provide a wider, but geographically specific perspective on the costs to consumers. The structure of the document is the following: after giving an economic overview of the gym membership contract, the main body of the dissertation aims at describing the contractual and non-contractual liabilities, which are analysed under the Italian legal system, but with a comparison with other relevant foreign cases. In conclusion there is a recap of the main liabilities that could arise and a perspective on stipulating an insurance contract to protect both the parties.
