Un'analisi dell'indipendenza del Kosovo: una sfida al Diritto Internazionale

This thesis provides a comprehensive analysis of the role of International Law in the Kosovo conflict, focusing in particular on the events surrounding the 2008 Unilateral Declaration of Independence. The study opens with a historical overview of the conflict, which already originated in ancient times, and explores the rise of Serbian nationalism in the modern state of Yugoslavia, raising the tension with Kosovo Albanians. Then, the work goes on to analyse the legal aspects of the conflict, including NATO's intervention, self-determination, territorial integrity, and sovereignty. The role of international institutions such as the ICJ, the UN, the IMF, and the World Bank, are also assessed in the resolution of the conflict, with a specific focus on the economic sphere of the conflict. The thesis concludes by offering critical insights into the lessons that can be learned from the Kosovo case regarding the application of International Law in similar situations and contributes to debates in the field of International Law and international relations. The Kosovo conflict provides valuable insights into the challenges and opportunities of using International Law to resolve complex and protracted disputes.
