The thesis deals with the protection of the visual arts, in particular color, articulated from a comparative perspective. Starting with a scientific definition of color, the latter will be precisely outlined from multiple points of view: from a historical, social and cultural point of view, the way in which color has always had a central place in human life since prehistoric times will be described, and how it has dictated the rhythm of human life, evolving over time. Subsequently, after analyzing the philosophical-scientific theories on color and how the human eye perceives it under different conditions, we will move on to a purely legal analysis of the legal protection that can be afforded to color, the benefits and flaws of each legal instrument will be analyzed, as well as the consequences that derive from each. Finally, the discussion will be shaped according to a legal and ethical vision to try to explain whether it is right to protect the visual arts in general through the law or whether or not such protection is in contrast with the fundamental principles of each person in making free use of every resource or good they need, emphasizing the importance of being able to express themselves freely and through every possible medium.
