Forced sterilization as a tool of oppression based on social grounds and the case law within the ECtHR.

The point of my research is to shine a light on a complex and invasive medical procedure, to which many women and people with a uterus are STILL today subjected to. More specifically, I would like to deepen the research and demonstrate how it has been used as a tool of oppression for specific categories of women, based on their gender, disabilities or ethnicity, in the case of Romani women. I would also like to tackle it within the context of people who are undergoing a gender reassignment procedure, who, to this day, are still forced to undergo such horrible and especially unnecessary procedures in order to obtain the change of their identity within their ID documents. Obviously the focus/evaluation will be a juridical one and will be dealt with through a legal perspective. Nonetheless my purpose is to show how the sociological factors such as gender, mental capacity or ethnicity are still the leading major factors causing it.

Lo scopo della mia ricerca è quello di evidenziare una procedura medica complessa e invasiva, alla quale molte donne e persone con un utero sono sottoposte ancora oggi. Più specificamente, vorrei approfondire la ricerca e dimostrare come sia stata utilizzata come strumento di oppressione per specifiche categorie di donne, in base al loro genere, disabilità o etnia, come nel caso delle donne rom. Vorrei anche affrontare la questione nel contesto delle persone sottoposte a una procedura di riassegnazione di genere, che ancora oggi sono costrette a sottoporsi a procedure tanto orribili e particolarmente inutili per ottenere il cambiamento della loro identità all'interno dei loro documenti d'identità. Ovviamente l'analisi sarà di matrice legale e sarà affrontata attraverso una prospettiva giuridica. Tuttavia il mio obiettivo è quello di mostrare come fattori sociologici come il genere, la capacità mentale o l'etnia sono ancora i principali fattori che lo causano.
