Diritto d'autore, blockchain e NFT

The following work aims to examine the impact of new technologies and digitisation on the way art is created, perceived, enjoyed and marketed. Our focus has in particular been on blockchain technology, which has enabled the development of a new type of goods: Non-Fungible Tokens. This 'new world' of 'new assets' brings with it numerous legal questions, especially when it comes to NFT Art. The purpose of this discussion is to examine this new environment and expose the major issues concerning copyright law and focus on the role of smart contracts.

Il seguente elaborato si propone di esaminare l’impatto delle nuove tecnologie e della digitalizzazione sul modo di creare, percepire, fruire e commercializzare l’arte. La nostra attenzione si è concentrata sulla tecnologia blockchain, che ha permesso lo sviluppo di una nuova tipologia di beni: i Non-Fungible Tokens. Tutto questo "nuovo mondo" di "nuovi beni" porta con se numerosi quesiti giuridici, specialmente quando si parla di Arte NFT. Lo scopo di questa trattazione è di esaminare questo nuovo ambiente ed esporre le maggiori problematiche relative al diritto d'autore e soffermandoci sul ruolo degli smart contracts.
