LE PSICOSI BREVI: ASPETTI PSICOPATOLOGICI E RISVOLTI FORENSI. ANALISI CRIMINOLOGICA DI UN CASO COMPLESSO.

The Brief Psychotic Disorder, included in the DSM-5 among the spectrum disorders of schizophrenia and other psychotic disorders, falls within the broader concept of brief psychosis, which over the years has undergone an evolution both in terms of diagnostic classification and classification of the disturbance for forensic purposes, fueling the jurisprudential debate on the issue of imputability. Through the study of the Italian jurisprudence on the subject of crimes against the person, selected on the basis of the appraisals and technical advice cited in the judgments of merit and legitimacy from the 90s to today, it has been possible to elaborate on the question of imputability and to highlight substantial difference between mental illness and mental infirmity. This work aims to explore the clinical aspects of brief psychosis, such as onset, symptoms, differential diagnosis and to understand the forensic implications.

Il Disturbo Psicotico Breve, inserito nel DSM-5 tra i disturbi dello spettro della schizofrenia e altri disturbi psicotici, rientra nel più ampio concetto di psicosi breve, che negli anni ha subìto una evoluzione sia per quanto riguarda la classificazione diagnostica, sia per l’inquadramento del disturbo a fini forensi, alimentando il dibattito giurisprudenziale sul tema dell’imputabilità. Attraverso lo studio della giurisprudenza italiana in materia di delitti contro la persona, selezionata sulla base delle perizie e delle consulenze tecniche citate nelle sentenze di legittimità dal 1996 a oggi, è stato possibile approfondire la questione sottolineare la differenza sostanziale tra malattia mentale e infermità mentale. Questo lavoro vuole esplorare gli aspetti clinici delle psicosi brevi, quali l’esordio, la sintomatologia, la diagnostica differenziale e comprenderne i risvolti forensi.
