La legislazione minorile: dal diritto all'esperienza

The thesis aims to find the lights and shadows of juvenile justice; more precisely, juvenile legislation related to my experience. Some articles of the constitution will be explained, including some primary principles and the main laws concerning minors, such as the right to education. We will examine the theme of the organization of social assistance, the national administration, the custody and their way of programming. Afterwards, we will deal with the issue of protecting minors and their family. In this regard, it will be noticeable not only the central role of the minor but also how his decisions are relevant from a legal point of view, even if they conflict with the adults' decisions. In the following part of my dissertation, the central theme will be parental responsibility and the measures following its revocation. Then we will enounce and examine the terms of the Juvenile Court, both definitive and temporary ones, along with the two judicial instruments to protect the minor: placement in community and family custody.

L'obiettivo della tesi è quello di scovare luci e ombre della giustizia minorile, in particolar modo verrà messa in relazione la legislazione minorile con la mia esperienza personale. Verranno spiegati alcuni articoli della costituzione, di cui alcuni principi fondamentali e alcuni articoli importanti quando si parla di minori, quale ad esempio il diritto all'istruzione. Verrà approfondito il tema dell'organizzazione dell'assistenza sociale, l'amministrazione nazionale, l'affidamento e il metodo di programmazione degli stessi. Successivamente verrà trattato il tema della tutela del minore e della famiglia, a questo proposito sarà possibile notare non solo il ruolo centrale del minore, ma anche come le sue decisioni siano importanti dal punto di vista giuridico, anche qualora entrino in contrasto con le decisioni dell'adulto. Nella seconda parte della tesi, il tema centrale è la responsabilità genitoriale e i provvedimenti in seguito alla revoca della stessa. Verranno enunciati i provvedimenti del Tribunale per i minorenni, sia quelli definitivi che quelli provvisori e verranno approfonditi due strumenti giudiziari a tutela del minore: il collocamento in comunità e l'affidamento familiare.
