This thesis examines the protection of human rights in the criminalization process in the European framework. It explores the importance of ensuring dignity and humane treatment in prisons, focusing on the crucial role of adequate healthcare and the detrimental effects of solitary confinement. The research highlights human rights violations in penal institutions and their consequences on prisoners. Through an analysis of the case Bamouhammad v. Belgium, the study illustrates the impact that certain incarceration practices have on prisoners’ mental health. This work highlights the need for penal institutions to comply with established fundamental human rights standards and uphold the dignity of all inmates.
