This thesis aims to highlight the notable but underestimated issue of abuse of power and torture. It is emphasized that torture is a violation of human dignity, which serves as the basis of all rights that an individual possesses. Abuse of power in detention centers is particularly analyzed, as this is an issue that few people give weight to, often considered a distant reality. At the international level particular emphasis was brought on the Convention Against Torture and its Optional Protocol, although one could focus on other conventions and treaties that are equally important, and in some cases even more defined. Italy, with its related problems in the introduction of the crime of torture, was analyzed and deepened, because besides being the country where I live and will likely continue to live, it was important to highlight the disastrous and unfortunate evolution that this crime has undergone in our country. The case of San Gimignano is analyzed in detail from the facts that took place to the sentencing, serving as a reminder that, in the end, justice prevails and the law is the same for everyone.
