Il riciclaggio di denaro attraverso i bitcoins e le valute virtuali

The purpose of this paper is to verify whether the current regulations are able to combat the various phenomena that revolve around money laundering. In fact, the first four directives, faced with a plurality of illegal and criminal cases, have implemented a whole series of measures and have provided indications on the collaboration to be implemented between the Member States, both aimed at circumscribing and limiting the effects of these phenomena. We were therefore able to observe what the response of the European Union has been, in particular through the V Directive, and whether this is sufficient to counter the phenomenon. It was also necessary to focus on how virtual currencies were born and how they operate, the main one being Bitcoin. This part, although very technical, is important to identify the reason for the illicit nature of bitcoin which now seems to be an uncontestable fact. This aspect is investigated in this paper. To solve this question, the intertwining of events that led to the origin of bitcoin was reconstructed.

Lo scopo del presente elaborato, è quello di verificare se le normative vigenti siano in grado di contrastare i vari fenomeni che girano attorno al riciclaggio di denaro. Di fatto le prime quattro direttive, di fronte ad una pluralità di fattispecie illegali e criminose, hanno attuato tutta una serie di provvedimenti ed hanno fornito indicazioni circa la collaborazione da attuare tra gli Stati membri, entrambi finalizzati a circoscrivere e limitare gli effetti di detti fenomeni. Abbiamo potuto osservare, quindi, qual è stata la risposta dell’Unione Europea, in particolare attraverso la V Direttiva, e se questa è sufficiente a contrastare il fenomeno. E’ stato, altresì, necessario, soffermarsi su come sono nate e come operano le valute virtuali, la principale delle quali è il Bitcoin. Questa parte, ancorché, molto tecnica, è importante per individuare il perché della natura illecita dei bitcoin che sembra oramai essere un dato non contestabile. In questo elaborato viene indagato proprio questo aspetto. Per risolvere tale quesito, è stato ricostruito l’intreccio di eventi che ha portato alla nascita del bitcoin.
