L' efficacia diretta della Carta dei Diritti Fondamentali dopo la sentenza Cresco Investigation

The contribution aims to provide a concise overview of the direct effect of the Charter of Fundamental Rights of the European Union in horizontal disputes, following the judgment of the CJEU of 22 January 2019 C-193/17 Cresco Investigation. After recalling, as far as it is of interest here, the main features of anti-discrimination law based on Directive 2000/78 and Article 21 of the Charter (section II), the contribution will proceed to reconstruct ( section III) the jurisprudential development of the recognition of the direct effect of the Charter. It then reconstructs the facts of the Cresco Investigation case and the four preliminary questions raised by the reference for a preliminary ruling (section IV), the arguments of Advocate General Bobek (section V), and the reasoning of the Court's decision (section VI). Finally, the concluding remarks (section VII) analyze the characteristics and problem profiles that emerge from this judgment.

Il presente lavoro mira a fornire un sintetico quadro dell’efficacia diretta della Carta dei diritti fondamentali dell’Unione Europea in controversie c.d. orizzontali, dopo la sentenza della Corte di Giustizia del 22 gennaio 2019 C-193/17 Cresco Investigation. Dopo aver richiamato, per quanto qui interessa, i tratti essenziali della normativa antidiscriminatoria fondata sulla direttiva 2000/78 e sull’art. 21 della Carta ( paragrafo II), il contributo procederà a ricostruire ( paragrafo III) lo sviluppo giurisprudenziale del riconoscimento dell’efficacia diretta delle Carta. Successivamente procederà a ricostruire i fatti della causa Cresco Investigation e le quattro questioni pregiudiziali sollevate con il rinvio pregiudiziale (paragrafo IV), le argomentazioni dell’Avvocato Generale Bobek (paragrafo V) e l’iter argomentativo della decisione della Corte (paragrafo VI). Infine le considerazioni conclusive (paragrafo VII) analizzeranno le caratteristiche e i profili problematici che emergono dalla sentenza in questione.
