L'attuazione della Convenzione di Aarhus nella giurisprudenza del Compliance Committee e della Corte di Giustizia dell'Unione Europea

The Aarhus Convention on Access to Information, Public Participation in Decision-Making and Access to Justice in Environmental Matters was adopted on 25 June 1998 at the Fourth Ministerial Conference in the ¿Environment for Europe¿ process and entered into force on 30 October 2001. The thesis aims at studying the implementation of the Convention in the case-law of the Compliance Committee and the Court of Justice of the European Union. A general overview introduces the requirements under the Aarhus Convention and the current state of transposition of the Aarhus requirements at the European Union level. It is brought into focus the analysis of the communications from the public before the Compliance Committee and the case-law of the Court of Justice of the European Union in relation to the Regulation 1367/2006 on the application of the provisions of the Aarhus Convention to EU institutions and bodies. The concluding part examines the emerging principles raised from the case-law of the Compliance Committee and the Court of Justice of the European Union.
