The rapid evolution of new technologies has posed new challenges in the context of International Humanitarian Law and Human Rights. This paper focuses on cyberwar as one of the main challenges for Human Rights in the realm of modern military operations. Cyberwar represents a form of conflict that leverages digital technologies to influence, disrupt, or damage the critical infrastructure of adversaries. Such operations can have a negative impact on fundamental Human Rights such as life, privacy, freedom of expression, and access to information. Therefore, it is essential to understand the legal and moral implications of these operations within the framework of existing international norms. Through an examination of the history of International Humanitarian Law and a reflection on its fundamental principles and their compatibility with the fifth dimension, this research explores the numerous characteristics of this digital weapon and presents the most significant case studies. It illustrates the possible implications that such a weapon can have in the present and the future, and proposes potential guidelines to address these challenges. ​

Il seguente elaborato si focalizza sulla cyberwar come una delle principali sfide per i Diritti Umani nell'ambito delle moderne operazioni militari. La cyberwar rappresenta una forma di conflitto che sfrutta le tecnologie digitali per influenzare, disturbare o danneggiare le infrastrutture critiche dei nemici. Tali operazioni possono avere un impatto negativo su Diritti Umani fondamentali come la vita, la privacy, la libertà di espressione e l'accesso all'informazione. Pertanto, è essenziale comprendere le implicazioni giuridiche e morali di tali operazioni nel quadro delle norme internazionali esistenti.
