Questioni in tema di responsabilità civile del notaio

The notary is at the center of the discussion of this thesis. Attention is paid in particular to in-depth analysis of the topic of civil liability. At first, the constituent elements of this liability are examined, namely: causal link, burden of proof, attribution of damage, compensation for the same and related settlement. Subsequently, the examination extends to a series of jurisprudential cases having as their petitum the request for compensation made by the plaintiff, who complains about the incorrect fulfillment of the professional service of the notary. The study is completed with a research concerning certain profiles of the notary's professional service, in particular with reference to the checks and assessments that the professional himself must carry out and whose completion is functional to achieving the result set by the parties.

La figura del notaio è al centro della trattazione di questa tesi. L’attenzione è rivolta in particolare all’ approfondimento del tema della sua responsabilità civile. In un primo momento si prendono in esame gli elementi costitutivi di tale responsabilità, vale a dire: nesso di causalità, onere della prova, imputazione del danno, risarcibilità dello stesso e relativa liquidazione. In seguito la disamina si estende ad una serie di casi giurisprudenziali aventi come petitum la richiesta risarcitoria avanzata dall’attore, che lamenta il non corretto adempimento della prestazione professionale del notaio. Lo studio si completa con una indagine avente ad oggetto taluni profili della stessa prestazione professionale del notaio, segnatamente con riferimento alle verifiche e accertamenti che lo stesso professionista deve eseguire ed il cui espletamento è funzionale al raggiungimento del risultato prefissato dalle parti.
