L'evoluzione delle associazioni professionali maggiormente rappresentative di area sanitaria in associazioni tecnico scientifiche ai sensi della legge 24/2017

Law 24/2017 and law 3/2018 have introduced important changes in the field of health professions, both for operators and for professional Associations of the health area. This thesis aims to trace the legislative reorganization which led to the recognition of professional Associations in Most Representative Associations (AMRs), analyze the development of Technical Scientific Associations (ATSs) and to outline the evolution of AMRs in ATSs. The case of the Italian Physiotherapists Association (A.I.FI.) is also described in the transition from AMR to ATS. A retrospective search of the Italian legislation on health professions was conducted, analyzing the current and future legislative implications for AMRs and ATSs. The reorganization process of the health professions, started with legislative decree 502/1992, led to the identification of 23 AMRs for institutional representation of professions without a professional College. Law 24/2017 has allowed AMRs to become also ATSs, with the aim of developing guidelines for health professionals; 15 AMRs have been recognized by the Ministry of Health as AMRs and ATSs. Subsequently to law 3/2018 and the establishment of the Orders of health professions, the AMRs are destined to lose the function of representativeness in favor of the Orders, but they will continue to exist and support the profession while preserving the role of ATSs. A.I.FI., already identified as AMR, has obtained the recognition as ATS thanks to a series of changes in its Statute and in its structure. With the loss of the institutional representative function of AMRs, A.I.FI. will continue to support the health profession of the physiotherapist in the field of scientific and research. The evolution of the professional Associations of the health area from AMRs to ATSs is going through a transition phase that will allow the Associations to remain active, but changing their aims towards the scientific and research aspects.

La L. 24/2017 e la L. 3/2018 hanno introdotto importanti cambiamenti in materia di professioni sanitarie, sia per gli esercenti sia per le Associazioni professionali di area sanitaria. Questa tesi si propone di tracciare il riordino normativo che ha portato al riconoscimento delle Associazioni professionali in Associazioni Maggiormente Rappresentative (AMR), analizzare lo sviluppo delle Associazioni Tecnico Scientifiche (ATS) delle professioni sanitarie e delineare levoluzione delle AMR in ATS. Viene inoltre descritto il caso dellAssociazione Italiana Fisioterapisti (A.I.FI.) nel passaggio da AMR a ATS. È stata condotta una ricerca retrospettiva della normativa italiana in materia di professioni sanitarie, analizzando le implicazioni legislative attuali e future per le AMR e le ATS. Il percorso di riordino delle professioni sanitarie, iniziato con il D.Lgs. 502/1992, ha portato allindividuazione di 23 AMR a rappresentanza istituzionale delle professioni prive di Collegio professionale. La L. 24/2017 ha consentito alle AMR di diventare anche ATS, con lo scopo di elaborare linee guida rivolte agli esercenti le professioni sanitarie; 15 AMR hanno ottenuto il riconoscimento da parte del Ministero della salute sia di AMR che di ATS. A seguito della L. 3/2018 e dellistituzione degli Ordini delle professioni sanitarie, le AMR sono destinate a perdere la funzione di rappresentatività in favore degli organismi degli Ordini, ma potranno continuare ad esistere e sostenere la professione conservando il ruolo di ATS. A.I.FI., già individuata come AMR, ha ottenuto il riconoscimento come ATS grazie ad una serie di modifiche nel suo Statuto e nella sua struttura. Con la perdita della funzione di rappresentatività istituzionale delle AMR, A.I.FI. potrà continuare a sostenere la professione sanitaria del fisioterapista nellambito scientifico e della ricerca. Il percorso di evoluzione delle Associazioni professionali di area sanitaria da AMR a ATS sta attraversando una fase di transizione che permetterà alle associazioni di rimanere attive, ma mutando i propri scopi verso gli aspetti scientifici e di ricerca.
