Il precedente giudiziale nelle Corti Supreme: le esperienze inglese ed italiana a confronto

This work focuses on the role that the legal precedent had and has in the two major legal systems: common law and civil law, and in particular in the English and the Italian law. The paper is an attempt to analyse the importance that the precedent has in the Supreme Courts of the two legal systems. In the UK there is the doctrine of stare decisis understood as the rule of binding precedent on the basis of which the decisions of the higher courts must necessarily be followed by the lower courts. However, in Italy, this rule is not binding because the primary source of our legal system is the parliamentary law. Though, the practice to follow the decisions of higher courts is increasingly consolidating. The dissertation is structured in three chapters, which provide an analysis of the various aspects and different characteristics of the two systems concerning the value of the precedent.

Il presente lavoro è incentrato sul ruolo che il precedente giudiziario ha avuto ed ha nei due maggiori sistemi giuridici: il common law e il civil law, ed in particolare nell'ordinamento giuridico inglese e in quello italiano. L'elaborato rappresenta l'analisi dell'importanza che il precedente riveste nelle Corti Supreme dei due sistemi giuridici. Nel Regno Unito esiste la dottrina dello stare decisis intesa come la regola del precedente vincolante in forza del quale le decisioni delle corti superiori devono obbligatoriamente essere seguite dalle corti inferiori. In Italia, invece, tale regola non è vincolante poichè la fonte primaria del nostro ordinamento è la legge parlamentare. Tuttavia la prassi di seguire le decisioni delle corti superiori si sta sempre più consolidando. Il lavoro è strutturato in tre capitoli nei quali si approfondiscono i diversi aspetti e le diverse caratteristiche dei due ordinamenti in merito al valore del precedente.
