Il Segretario comunale

In this thesis it has been done an historical overview of the town clerk , it is starting from the first law of post unitay Italy to the abrogate offert made by D.d.L 1577/2014 convert in law 124/2015. By the years this person had different connotations, it had been object of great reforms intervenned on either persons or in general local societies. With the changing of legislations it has been changed also approach at this sogget: initially considered the pivot around which spin the complete admini-strative structure, in the last decade the town clerk it had been object of big debates about his indi-spensability and it started talking about the abrogation. The last law adopted concerning the public administration reform it had expected the ultimately abrogation about the sogget, marking the end of an epoch durated more than one hundred fifty years.

In questo lavoro di tesi è stata fatta una digressione storica della figura del Segretario comunale, partendo dalla prima legge dell'Italia post unitaria fino all'odierna proposta di abolizione operata dal Disegno di legge 5777 del 2014 convertito in legge 124 del 2015. Nel corso degli anni questa figura ha assunto diversi connotati, è stata oggetto di grandi riforme intervenute sia sulla figura stessa che sugli enti locali in generale. Con il cambiare delle legislazioni è cambiato anche l'approccio a questo soggetto: inizialmente considerata il cardine attorno al quale ruota l'intera struttura amministrativa, nell'ultimo decennio il Segretario è stato oggetto di grandi dibattiti circa la sua indispensabilità e si è iniziato a parlare di abolizione. L'ultima legge emanata in materia di riforma della Pubblica amministrazione ha previsto l'abolizione definitiva di questa figura, segnando la fine di un'epoca durata più di centocinquant'anni.
