L'istituto della sacertà nell'ultima dottrina romanistica

Istituto di rilievo nel diritto penale romano è la sacertà, fattispecie a carattere giuridico-religioso, che comportava l'espulsione del reo dalla comunità a seguito dell'infrazione della "pax deorum". Rilevante è la comminazione della sanzione, il punto focale su cui la dottrina si è incentrata è se sia sufficiente espellere il soggetto dalla comunità oppure ne sia lecita persino l'uccisione. L'indagine delle fonti letterarie e giuridiche ivi presenti proverà a delineare un quadro definito della figura, alla luce delle più antiche e recenti indagini dottrinarie, attraverso un'approfondita analisi della figura stessa.
