Libertà di espressione e disinformazione online: il bilanciamento tra tutela dei diritti fondamentali e regolamentazione dell’Unione europea

This thesis examines the complex relationship between freedom of expression and online disinformation, with particular attention to balancing the protection of fundamental rights and the regulation of the European Union. The analysis focuses on freedom of expression within the European legal framework, highlighting the principles enshrined in the European Convention on Human Rights and the Charter of Fundamental Rights of the EU. The phenomenon of online disinformation is explored in depth, examining its causes and consequences, along with the regulatory tools and initiatives adopted by the EU to counter the spread of misleading content. Finally, the study analyzes the delicate balance between safeguarding freedom of expression and the need to limit disinformation, emphasizing the challenges and future prospects of European regulation in this field.

La presente tesi esamina il complesso rapporto tra la libertà di espressione e la disinformazione online, con particolare attenzione al bilanciamento tra la tutela dei diritti fondamentali e la regolamentazione dell'Unione Europea. L’analisi si concentra sulla libertà di espressione nell’ordinamento europeo, soffermandosi sui principi sanciti dalla Convenzione europea dei diritti dell’uomo e dalla Carta dei diritti fondamentali dell’UE. Viene approfondito il fenomeno della disinformazione online, le sue cause e conseguenze, esplorando gli strumenti normativi e le iniziative adottate dall’UE per contrastare la diffusione di contenuti ingannevoli. Infine, viene analizzato il delicato equilibrio tra la tutela della libertà di espressione e la necessità di limitare la disinformazione, evidenziando criticità e prospettive future della regolamentazione europea in materia.
