Una giustizia in panne: il conflitto fra giustizia morale e giustizia dei codici nei romanzi di Friedrich Dürrenmatt

This thesis intents to analyse four of Dürrenmatt's fictions: The judge and his hangman (1952), Suspicion (1953), A Dangerous Game (1956) and The Pledge (1958), specifically the ways in which the juridic system fails in these works. With "juridic system" I intend the complex of norms that regulate a State and determine the rules the citizens ought to follow. This analysis will be conducted by taking in exam the main characters of these works, dividing them between the ones that make the rules and the ones who break them. The failing of the juridic system will not be the main subject of interest, but this thesis will also dive into the conflict between the legal justice and the moral justice. With moral justice I mean that kind of justice that does not find its meaning through laws and codes, but is a more private one, that battles with what is good and bad. In Friedrich Dürrenmatt's works this conflict is rendered by the "avengers", who, since they cannot be helped by the laws, choose to go against them to restore the order of the world.

Il presente lavoro di tesi intende analizzare quattro opere di Friedrich Dürrenmatt: Il giudice e il suo boia (1952), Il sospetto (1953), La panne (1956) e La promessa (1958) in particolare per quel che riguarda le modalità in cui il sistema delle leggi fallisce al loro interno. Per “sistema delle leggi” intendo il complesso di norme che ordinano e disciplinano uno Stato, che determinano il comportamento e le regole che i cittadini devono seguire. A tale scopo, vengono presi in esame i personaggi principali, suddividendoli fra coloro che incarnano ruoli legati alla legge e i loro antagonisti criminali. È inoltre necessario specificare che non viene analizzato esclusivamente quando il sistema delle leggi, a cui mi riferisco con il termine giustizia legale, fallisce all’interno dei romanzi, ma anche quando questo tipo di giustizia entra in contrasto con un secondo, al quale mi riferisco con il termine giustizia morale. Per giustizia morale intendo quel tipo di giustizia che non passa necessariamente attraverso leggi, tribunali o processi, ma che piuttosto fa leva su una componente morale, che quindi è sia privata, che talvolta universale. All’interno dei romanzi di Friedrich Dürrenmatt questo contrasto è evidente e si palesa negli stessi “giustizieri”, i quali sono spinti dalla manchevolezza della giustizia legale a scavalcarla per poter riportare ordine ed equilibrio.
