L'impatto della riforma Cartabia nell'ordinamento giuridico Italiano

In this elaborate, we will talk about the consequences that the Cartabia reform has led to Italian food legislation. The legislation on agri -food supply chains are focused on the principles of Food Safety and Food Security, principles that the European Union harmonizes through Community agricultural policy and ensures compliance through Reg. EU 2017/625, relating to official checks, also part of the CAP. In Italy there was already, previously to the issuing of the Regus of 2017/625, L. 283/1962 which has been the subject of changes and which has recently been invested by the effects of article 70 of Legislative Decree 150/2022 c.d. Cartabia reform, which brought considerable evolutions, in agri -food matters, bringing out questions that could lead to problems through the adoption of "extinctive prescriptions". The goal and evaluate the effectiveness of this institution in the sector, exposing contact and divergence points between the ratio of the reform and the regal 2017/625.

In questo elaborato, si parlerà delle conseguenze che la riforma Cartabia ha portato nella legislazione alimentare Italiana. Le legislazioni in materia di filiere agroalimentare sono incentrate sui principi di food safety e food security, principi che l’Unione Europea armonizza tramite la politica agricola comunitaria e ne assicura il rispetto tramite il Reg. Eu 2017/625, relativo ai controlli ufficiali, anche esso parte della Pac. In Italia esisteva già, precedentemente all’emanazione del Reg 2017/625, la L. 283/1962 che è stata oggetto di modifiche e che recentemente è stata investita dagli effetti dell’articolo 70 del D.Lgs 150/2022 c.d. Riforma Cartabia, che ha portato delle notevoli evoluzioni, in materia agroalimentare, facendo emergere dei quesiti che potrebbero portare a delle problematiche mediante l’adozione di “prescrizioni estintive”. L obiettivo e valutare l'efficacia di tale istituto nel settore, esponendo punti di contatto e di divergenza tra la ratio della riforma e il Reg 2017/625.
