COMPARATIVE ANALYSIS OF THE EFFECTIVENESS OF WIPO ADR MECHANISMS IN RESOLVING INTERNATIONAL INTELLECTUAL PROPERTY DISPUTES

In today's globalizing world, the economic value of intellectual and industrial properties is rapidly increasing. In this context, the need for rapid, confidential, and impartial resolution of disputes arising from these properties has become more critical than ever. There is a global need for institutions like WIPO to have the capacity and competence to provide solutions to disputes arising from international intellectual property rights. WIPO, one of these institutions, not only resolves disputes but also plays a pivotal role in encouraging states to cooperate in protecting intellectual property rights. In this study, the nature of intellectual property related disputes will be discussed. The functioning of alternative dispute resolutions offered by the WIPO mediation and arbitration center will be touched upon. Then, their applicability will be examined in comparison with the US Litigation system by applying the AHP method to certain criteria. The effectiveness of ICC and AAA organizations in providing Alternative Dispute Resolution services in resolving intellectual property disputes will also be discussed.
