L’indagine del Mediatore europeo sulle “porte girevoli” nella carriera degli (ex) funzionari della Commissione europea

The text deals with the methods and conclusions of investigations carried out by the European Ombudsman against the European Commission in a phenomenon called "revolving doors". The European Ombudsman is of absolute importance in ensuring good administration by the European institutions and guaranteeing citizens that their rights are protected. Therefore, a focus will be made on the figure of the European Ombudsman, from his origins to the functions he performs and the decisions he makes regarding the investigation of cases of maladministration. After a more general analysis of the figure, the paper will focus on the investigation conducted by the Ombudsman, Emily O'Reilly, against the European Commission and, in particular, will refer to a phenomenon known as "revolving doors." The thesis will be demonstrated through the presentation and description of the case initially in a more general view, then by deepening the Ombudsman's decision and conclusions in this regard.

Il testo tratta delle modalità e delle conclusioni di indagine svolte dal Mediatore europeo nei confronti della Commissione europea in un fenomeno denominato “porte girevoli”. Il Mediatore europeo è di assoluta importanza per assicurare una buona amministrazione da parte delle istituzioni europee e garantire ai cittadini che i loro diritti vengano tutelati. Per questo verrà approfondita la figura del Mediatore europeo, dalle sue origini alle funzioni che svolge, fino alle decisioni che prende riguardo alle indagini sui casi di cattiva amministrazione. Dopo un’analisi più generale della figura, l’elaborato si concentrerà sull’indagine condotta dal Mediatore, Emily O’Reilly, nei confronti della Commissione europea e, in particolare, farà riferimento a un fenomeno noto come “porte girevoli”. La tesi verrà dimostrata attraverso la presentazione e la descrizione del caso inizialmente in linea più generale, poi approfondendo la decisione e le conclusioni del Mediatore al riguardo.
