Il lato oscuro dell'e-commerce. Le pratiche commerciali scorrette e la sfida della tutela dei consumatori

The body of the thesis deals with a reference case related to the unfair commercial practices in the field of electronic commerce and the related measure issued by the Competition and Market Authority. From this event we continue with a deepening of what are the regulatory aspects that govern the matter, paying particular attention to the cd. Code of the Consumption and to the cd. Directive Omnibus. Moreover, in the course of the elaboration, some similar cases of intervention by the AGCM are analyzed and the attention is turned also to an increasingly important aspect, the public opinion. ​

Nel corpo della tesi viene affrontato un caso di riferimento inerente alle pratiche commerciali scorrette poste in essere nel settore del commercio elettronico e il relativo provvedimento emesso da parte dell'Autorità Garante della Concorrenza e del Mercato. Da tale evento si prosegue con un approfondimento di quelli che sono gli aspetti normativi che disciplinano la materia, prestando particolare attenzione al cd. Codice del Consumo e alla cd. Direttiva Omnibus. Inoltre, nel corso dell'elaborato, si analizzano alcuni casi analoghi di intervento da parte dell'AGCM e si volge lo sguardo anche ad un aspetto sempre più rilevante, l'opinione pubblica.
