Conservazione dei dati e diritto all'oblio, prima e dopo il GDPR

The central theme of the degree thesis is data retention and the right to be forgotten, that is the right of everyone to have their personal data deleted. The discussion begins with a general part, including the general provisions of the 2016/679 Regulation, the protagonists of the Regulation and the fundamental principles on which it is based; in order to have a greater awareness of the points covered in the in-depth chapter. In the latter, the historical evolution of the right to be forgotten, its basis and its characteristics and the modalities for exercising the right to erasure of data are exposed. Finally, its relationship with the right to information and the right to report will be examined, analyzing some important sentences for the definition of the boundaries of rights.​

Il tema centrale della tesi di laurea è la conservazione dei dati ed il diritto all'oblio, ovvero il diritto di ognuno di veder cancellati i propri dati personali. La trattazione comincia con una parte generale, comprendente le disposizioni generali del Regolamento 2016/679, i protagonisti del Regolamento ed i principi fondamentali su cui si fonda; al fine di avere una consapevolezza maggiore dei punti trattati nel capitolo di approfondimento. In quest'ultimo, viene esposta l'evoluzione storica del diritto all'oblio, il suo fondamento e le sue caratteristiche e la modalità di esercizio del diritto alla cancellazione dei dati. Infine, verrà esaminato il suo rapporto con il diritto all'informazione ed il diritto di cronaca, analizzando alcune sentenze importanti per la definizione delle linee di confine dei diritti.​
