Diritto e Letteratura: la giustizia di Shakespeare in The Merchant of Venice e Measure for Measure e Shakespeare nelle aule di giustizia

At present, Shakespeare is still universally acknowledged as the most eminent and authoritative dramatist of the whole Western literary canon, his works stand out for their extraordinary modernity and appeal to all people in every epoch. The objective of this thesis is to show that Shakespeare's cultural heritage is still one of the most important points of reference in our society through the analysis of his role within the movement «Law and Literature» and two of its sub-disciplines, «Literature in Law» and «Law in Literature». As to the former, which focuses on the study of the use of literary quotations and references in common law's Courts of Justice, Shakespeare is the most-referenced fiction author: this thesis points out the reasons of his supremacy and determines the importance of the crossroad of law and literature by the means of the illustration of some court decisions where Shakespeare's works were used and were relevant in the explanation of the legal issues involved and in the resolution of the case. On the other hand, within the sub-movement «Law in Literature», which focuses on the study of the way in which legal themes are presented in literary works, Shakespeare's valuable contribution and his outstanding modernity are pointed out through the analysis of his two legal plays, The Merchant of Venice and Measure for Measure, and of the concept of justice they illustrate. Shakespeare's ability to deal with legal situations is remarkable, providing further evidence of his genius, his immortality and his timeless value.

Shakespeare è ancora oggi concordemente acclamato come il drammaturgo più eminente ed autorevole dell'intero patrimonio letterario occidentale e la sua opera si distingue per la sua eccezionale capacità anticipatrice ed il suo carattere universale ed atemporale. Scopo di questa tesi è mostrare come l'eredità shakespeariana continui a costituire un punto di riferimento fondamentale nella nostra società attraverso l'analisi del ruolo da essa svolto all'interno del movimento «Law and Literature» e di due delle sue specifiche prospettive, «Literature in Law» e «Law in Literature». Nell'ambito della prima, incentrata sullo studio delle citazioni e dei riferimenti letterari fatti dagli operatori del diritto presso le aule di giustizia di common law, Shakespeare detiene il primato di autore più citato: la tesi illustra quindi le ragioni alla base di tale preminenza e dimostra l'efficienza dell'utilizzo della letteratura nel campo del diritto attraverso il resoconto di alcune vicende giudiziarie nelle quali il ricorso ad opere di Shakespeare è risultato funzionale alla loro delucidazione e risoluzione. All'interno della prospettiva «Law in Literature», imperniata invece sullo studio della trattazione del diritto nelle opere letterarie, l'apporto fornito da Shakespeare e la sua straordinaria modernità sono presentati tramite l'analisi dei suoi due drammi legali, The Merchant of Venice e Measure for Measure, e del concetto di giustizia che da essi emerge. La perizia con la quale Shakespeare padroneggia la tematica giuridica è infatti tale da confermare il suo genio e sancire la sua immortalità e la sua valenza intramontabile.
