Le unioni civili in Unione Europea

This work aims to analyze how new unions have contributed to modifying the traditional institution of marriage and more generally the new notion of family in the European panorama, to which the sentences of the Court of Justice and the ECtHR have made a decisive contribution. A comparative reading will also be offered on how the major European states have addressed such a current issue, in particular with respect to the Italian case, with a focus on law 76/2016 and the troubled process of approving the law, touching on the most current issues and debates on filiation and same-sex couples.

Il presente lavoro vuole analizzare come le nuove unioni abbiano contribuito a modificare la tradizionale istituzione del matrimonio e più in generale la nuova nozione di famiglia nel panorama europeo, a cui hanno dato decisivo contributo le sentenze della Corte di Giustizia e della Corte EDU. Verrà offerta anche una lettura in chiave comparatistica su come i maggiori stati Europei abbiano affrontato una tematica così attuale, in particolare rispetto al caso italiano, con un focus sulla legge 76/2016 e sul travagliato iter di approvazione della legge, sfiorando le tematiche più attuali e dibattute sulla filiazione e sulle coppie omogenitoriali.
