La Resurrezione Delle Formalità del Diritto D'autore Nell'era Blockchain

The idea of resurrecting copyright formalities has emerged only recently due to the awareness that these formalities can perform important functions in the modern digital era. It has received increased attention at the national and international levels. The reintroduction of copyright formalities depends solely on the type of formalities that will be introduced, and the legal consequences attached to them. Today, the resurrection of copyright formalities can take different forms and can take place through highly sophisticated technologies, including distributed ledger technology. Moreover, the resurrection of formalities requires realistic and manageable modifications to international and national laws without posing any threat to the interests of any group of the copyright society. With clear measures regulating copyright protection, and a formalities system making use of the most advanced technology, a newly formalized system would include the best aspects of international and national copyright systems, while leaving all the administrative difficulties behind. This paper further proposes the resurrection of copyright formalities, through the use of highly sophisticated distributed ledger technologies (blockchain), accompanied with legislative reforms, that will effectively make copyright law better fit to face the challenges of today’s highly digitized world.
