This analysis is focused on the concept of restorative justice which has a long history but is a theme that emerged and was put to the attention of studies and research in recent years. In particular, the study will concentrate on the different models of restorative justice, the offence, therefore, has a different value, it is no longer understood as the damage that the individual does to the State, on the contrary, the offence is to be considered in terms of violation of the person and interpersonal relations. It focuses especially on the importance of the victim and wrongdoers in the opportunity to express their feelings and to establish a direct dialogue in order to have back what both have lost due to the crime. Further, the analysis will provide the restorative justice application and its development and impact on the transnational system after the Apartheid era. Restorative justice had a primary role in the post-apartheid process, The Promotion of National Unity and Reconciliation 1995 established the creation of the Truth and Reconciliation Commission which began the long path to democracy through reconciliation in order to repair and prevent further violations. Then will be deepened as restorative justice impacts the different transnational systems, its institution, and how the institutionalization of this justice with its various instruments through which it takes place works.
