Abstract

The increase of inter connectivity among the countries is nothing but globalization. This inter connectivity between the countries lead to the enormous economic and social development which results in the better standard of living and good quality of life. But, is globalization showing the same impact on both developed and underdeveloped countries? Although some countries have successfully adapted to the changes, challenges and the benefits of globalization, the results are not the same for everyone. There is a considerable disagreement about whether globalization is equally beneficial for all the countries or is it more favourable to the developed countries. There is no escape from the fact that globalization made the rich become rich and the poor became poor. Well, the law plays an important role in globalization. The main question here is whether the law and politics are affecting globalization or affected by globalization. The legal system holds a great power in globalization. This paper gives detailed information about the comparison of two under developing countries in five different aspects to approach the legal aspects and effects of globalization. Here we discuss the history of globalization, legal aspects of globalization, law and economy, political aspects in India and South Africa, and the methods to implement. This research in those 5 different topics helps to demonstrate about how the law and politics affects the country’s economy, global markets, transnational enforcement of law, emergence of new branches in politics, Indian and South African trade with the world. Both countries have since developed close strategic, cultural and economic ties. There are also significant differences between the two countries. For , India is a more diverse country than South Africa, with a large population of Muslims and Christians. India is also a much more populous country, with over 1.3 billion people compared to South Africa's 54 million people. Despite the differences between the two countries, there are also many similarities. For example, both countries have a rich history and culture. Both countries were also colonized by the British. India was a colony from 1858 to 1947, while South Africa was a colony from 1806 to 1910. One might think that legislation has little to do with this phenomenon, other than erasure, except where laws help create markets and ensure they function properly. But the reality of globalization is challenging such formulas, and this article argues that the law has an important role to play. The contexts in which the law is relevant reflect the variety of legal relationships, circumstances and arrangements in which globalization is now evolving. This article will look at three of these contexts. The first deals with multilateral treaties, the second deals with corporate social responsibility and voluntary regulation, and the third deals with domestic law. Globalization is driving to more prominent issues of state capacity to comply with human rights commitments, especially financial, social rights, such as exchange union flexibilities, the right to work, and the proper to social security. It too may have an unbalanced impact on minorities. The future research highlights the challenges and changes made by the legal system of India and South Africa. Giving the conclusion by showing methods to implement In both India and South Africa to help them become a developed country from being an under developing country.
