Digitalisation and democracies cannot be separated from each other in the present day. Yet, the slow pace of the legislative processes are falling behind the technological developments and the challanges it brings to our lives. There are multiple hardships regarding law- making on digitalisation at both in international transnational scale. In this paper, the regulations in the Nordic countries on privacy and surveillance legislation will be demonstrated despite to the problems mentioned earlier. Hardships of providing a balance between law and digitaisation through legislation will be discussed by illustarting how the legal framework on privacy and surveillance is managed in the countries at stake which are generally considered “ well- governed”.
