L'atleta di formazione non italiana

The thesis analyzes the figure of the athlete with a not-Italian training in the light of the judgments of the European Court of Justice and the judgment Pitavino-Monteagudo. Starting from an analysis of the principles of the treaties on which the EU is founded, the goal is to shed light on the free movement of athletes in the European territory, the significance of citizens, workers and athletes of the European Union. The regime of international education is addressed through the analysis of judgments that have rocked the sporting world since the seventies to today. Finally it is pointed out the treatment of the athlete in Italy, in particular the relationship between sports regulations and laws of the Republic, protection of the nurseries and the situation of youth employment sport in Italy.

La tesi analizza la figura dell'atleta di formazione non italiana alla luce delle sentenze della Corte di giustizia europea e della sentenza Pitavino-Monteagudo. Partendo dall'analisi dei principi dei Trattati sui quali si fonda l'UE, l'obiettivo è di far luce sulla libera circolazione dello sportivo nel territorio europeo, sul significato di cittadino, lavoratore e sportivo dell'Unione europea. Il regime di formazione internazionale è affrontato tramite l'analisi delle sentenze che hanno scosso il mondo sportivo dagli anni settanta ad oggi. Infine è sottolineato il trattamento dell'atleta in Italia, in particolare il rapporto tra ordinamento sportivo e ordinamento della Repubblica, la tutela dei vivai giovanili e la situazione del lavoro subordinato sportivo in Italia.
