Technology has highly influenced creative processes, to the point that, today, a whole genre can be identified for being constituted by artworks produced and experienced through digital media. Such works – which are generally referred to as digital art – have been challenging the traditional criteria for copyright recognition developed by both international and national legal systems. These include, for instance, the fixation requirement, the idea/expression dichotomy and the very concept of authorship. Against this backdrop, this research aims to provide a wide-ranging examination of the legal implications that digital art may entail, by also presenting some future perspectives for the development of more inclusive copyright systems.
