L'attività dell'impresa sociale - Profili giuridici

This dissertation aims to outline, at the dawn of a major reform, one of the key actors of the third sector: the social enterprise. This enterprise was set up by the Government Decree n. 155 on 2nd March 2006, due to the need to simplify the legal framework of the third sector. Today we can say that this sector still remains messy and fragmented. In this dissertation we will try to clarify this phenomenon, which in our society is far from being minor, and will place it in the huge scenery of no-profit organizations, figuring out which competitors have grown in the social sector. As a matter of fact, the law on social enterprises has had less impact than expected and its reform is highly claimed. For this reason, in May 2014, the Government drafted its guidelines, stating the criteria for a comprehensive revision of the legislation on community service, social cooperation, non-profit associations, foundations and social enterprises. The Italian Parliament has now approved the bill and in a year the relevant working papers should be ready.

Questa tesi di laurea ha l'obiettivo di delineare, all'alba di un'importante riforma, uno degli attori fondamentali del terzo settore: l'impresa sociale. Il Decreto legislativo n. 155, emanato dal Consiglio dei Ministri il 2 marzo 2006, in attuazione della legge delega del 13 giugno 2005 n. 118, ne ha sancito la nascita. A spingere il legislatore verso tale intervento normativo fu la necessità di semplificare il quadro giuridico del terzo settore, che però è rimasto ancora confuso e frammentato. Nel corso dello scritto si cercherà di chiarire questo fenomeno, tutt'altro che marginale nella nostra società, cercando di collocarlo nell'ambito del vasto panorama delle organizzazioni senza scopo di lucro e cercando di capire inoltre quale altre concorrenti si sono sviluppate nel settore a vocazione sociale. La legge sull'impresa sociale ha avuto un impatto notevolmente inferiore alle aspettative e la sua riforma era da tempo attesa, tanto che nel maggio 2014, il Governo ne ha predisposto le linee guida, formulando i criteri per una revisione organica della legislazione riguardante il volontariato, la cooperazione sociale, l'associazionismo non-profit, le fondazioni e le imprese sociali.
