Il diritto attico come base del sistema politico democratico e dei principi giuridici moderni ​

The Theme of Attic Law as a Basis for Modern Democratic Principles The theme I have chosen to address is that of Attic law as a springboard for the modern democratic political system and, more generally, as a foundation for the construction of the principles that currently govern our legal systems. I have chosen to develop this theme after undertaking a course in ancient Greek law, in which I realized that Athenian society, despite having operated millennia ago, was fundamental - from various perspectives - in reaching the modern democratic and rule-of-law society. The objective is not the absolute equation between two legal systems (such as that between two modern legal systems) given the diversity of era and culture between the two, but rather the search for a foundation, a commonality of principles where it would be difficult to imagine; principles that have sometimes been lost and rediscovered over time. It is possible to carry out this kind of reflection because the absence of a science of law in the Greek world did not mean a lack of legal knowledge; on the contrary, the legal phenomenon was well perceived by everyone and manifested itself in every circumstance of the social life of the polis. This comparison will be made by focusing on some legal themes - rather than on the entirety of the legal system - and these are the themes that most strongly capture the consonance and on which a more in-depth reasoning can be made on the principles that inspire these legal systems. ​

Il tema che ho deciso di trattare è quello del diritto attico quale spunto per il moderno sistema politico democratico e più generale quale base per la costruzione dei principi che oggi governano i nostri ordinamenti. Ho scelto di sviluppare questo tema dopo aver intrapreso il corso di diritto greco antico in cui mi sono resa conto di come la società ateniese, nonostante abbia operato millenni fa, fu fondamentale -sotto diversi punti di vista- per arrivare alla moderna società democratica e di diritto. L'obiettivo non è l’assoluta equiparazione tra due ordinamenti giuridici (quale potrebbe essere quella tra due ordinamenti moderni) data la diversità di epoca e cultura tra i due, quanto piuttosto la ricerca di un fondamento, una comunanza di principi laddove difficilmente si potrebbe immaginare; principi che poi nel tempo si sono talvolta persi e ritrovati. È possibile attuare una riflessione di questo tipo in quanto l’assenza di una scienza del diritto nel mondo greco non ha significato mancanza di conoscenza giuridica, anzi il fenomeno giuridico era ben avvertito da tutti e si manifestava in ogni circostanza della vita sociale della polis. Questo confronto verrà fatto concentrandosi su alcuni temi giuridici -piuttosto che sulla totalità dell’ordinamento- e si tratta dei temi che maggiormente colgono l’assonanza e sui quali si può fare un più approfondito ragionamento sui principi che ispirano tali ordinamenti. ​
