IL FONDO PATRIMONIALE ED IL TRUST NELLA CRISI CONIUGALE

This thesis examines the institutions of trust and the family fund, two significant legal tools for managing and protecting family assets during marital crises. It specifically analyzes how these instruments, despite their different origins and structures, are used in the Italian context to safeguard the interests of spouses and children. The trust, of Anglo-Saxon origin, is evaluated in light of the Hague Convention and Italian legislation, while the family fund, rooted in the Italian legal tradition, is examined in its application and limitations. The thesis is structured into three main chapters: the first dedicated to the family fund, the second to the trust, and the third to a comparison between the two instruments, with a particular focus on their application during marital crises. The analysis is based on legal sources, doctrine, case law, and practical cases, aiming to provide a comprehensive and up-to-date understanding of these legal tools and their role in protecting family assets.

La tesi esamina l'istituto del trust e del fondo patrimoniale, due strumenti giuridici rilevanti per la gestione e protezione dei beni familiari durante le crisi matrimoniali. In particolare, analizza come questi strumenti, sebbene diversi per origine e struttura, siano utilizzati nel contesto italiano per tutelare gli interessi dei coniugi e dei figli. Il trust, di origine anglosassone, viene valutato alla luce della Convenzione dell’Aia e della normativa italiana, mentre il fondo patrimoniale, radicato nella tradizione giuridica italiana, viene esaminato nella sua applicazione e limitazioni. La tesi si articola in tre capitoli: il primo dedicato al fondo patrimoniale, il secondo al trust, e il terzo al confronto tra i due strumenti, con particolare attenzione alla loro applicazione nelle crisi matrimoniali. L'analisi si basa su fonti giuridiche, dottrina, giurisprudenza e casi pratici, al fine di fornire una comprensione approfondita e aggiornata di questi strumenti giuridici e del loro ruolo nella protezione dei beni familiari.
