Forme di contiguità all'associazione di tipo mafioso e responsabilità penale

This paper explores the complex scenario surrounding mafia-type associations, conducting research that starts from the promulgation of the Rognoni-La Torre Law, up to the analysis of the structure and rationale of Article 416 bis of the penal code. Through an examination of fundamental jurisprudence, from the Demitry ruling of 1994 to the Contrada case, the thesis addresses the controversial debate regarding positions of external complicity and associative participation, also presenting a socio-criminological perspective on the topic. The central focus of this dissertation concerns the political-mafia nexus, focusing primarily on the State-Mafia negotiations, the political figures involved, and, by reporting the various doctrinal and jurisprudential positions on the matter, also addressing the issue of distinction between political and legal responsibility. Subsequently, a thorough analysis of Article 416 ter of the penal code is provided, tracing its evolution through the three main legislative interventions. In conclusion, this study examines the nexus in entrepreneurial spheres, shedding light on white-collar crimes and the various conceivable scenarios, ranging from complicit entrepreneurs to victims. The aim of this thesis is to understand the nature of various mafia associations and their implications on criminal responsibility and socio-political dynamics.

Il presente elaborato esplora il complesso scenario che circonda le associazioni di tipo mafioso, conducendo una ricerca che parte dalla promulgazione della Legge Rognoni-La Torre, fino ad arrivare all’analisi della struttura e della ratio dell’articolo 416 bis del codice penale. Attraverso una disamina della giurisprudenza fondamentale, dalla sentenza Demitry del 1994 al caso Contrada, la tesi affronta il dibattito controverso circa le posizioni del concorso esterno e della partecipazione associativa, presentando anche uno sguardo socio-criminologico sul tema. Il focus centrale di questa dissertazione riguarda la contiguità politico-mafiosa, concentrandosi soprattutto sulla trattativa Stato-Mafia, sulle figure politiche coinvolte e, riportando le diverse posizioni dottrinali e giurisprudenziali sulla materia, si affronta anche il tema della distinzione tra responsabilità politica e legale. Successivamente viene fornita un’analisi approfondita dell’articolo 416 ter codice penale, tracciando la sua evoluzione attraverso i tre principali interventi legislativi. Per concludere, il presente studio esamina la contiguità nelle sfere imprenditoriali, facendo luce sui crimini dei colletti bianchi e sulle diverse fattispecie configurabili, che vanno dall’imprenditore complice a quello vittima. Questa tesi ha lo scopo di far comprendere la natura delle varie associazioni mafiose e le loro implicazioni sulla responsabilità penale e sulle dinamiche socio-politiche.
