The thesis deals with analyzing the historical reasons that led to the recognition of the right to health protection in the Constitution and with analyzing its profiles to understand whether the right to health must always be balanced with other constitutionally guaranteed rights or, if and under what circumstances, it can be considered a super partes right compared to the other rights protected by the Constitution ​

L'elaborato si occupa di analizzare le ragioni storiche che hanno condotto al riconoscimento nella Costituzione del diritto alla tutela della salute e di analizzarne i profili per comprendere se il diritto alla salute debba essere sempre posto in bilanciamento con gli altri diritti costituzionalmente garantiti oppure, se ed in quali circostanze, possa essere considerato un diritto super partes rispetto agli altri diritti tutelati dalla Carta fondamentale. ​
