Da un punto di vista legale, esistono spesso norme e procedure specifiche che i datori di lavoro devono seguire per garantire che i licenziamenti collettivi siano effettuati in modo equo e trasparente, tenendo conto dei diritti e delle tutele dei dipendenti interessati. Fattori economici, condizioni del mercato del lavoro e tendenze del settore possono influenzare il processo decisionale dei datori di lavoro quando prendono in considerazione il licenziamento collettivo. Anche le dinamiche sociali, come le relazioni con i dipendenti, la cultura organizzativa e gli interessi delle parti interessate, possono modellare il modo in cui il licenziamento collettivo viene percepito e gestito. Inoltre, considerazioni etiche, come l’equità, la giustizia e la dignità umana, svolgono un ruolo cruciale nel determinare le implicazioni morali del licenziamento collettivo e le responsabilità dei datori di lavoro nei confronti dei propri dipendenti. Il licenziamento collettivo, noto anche come licenziamento di massa o licenziamento, è diventato un fenomeno comune nel mondo del lavoro moderno a causa di vari motivi, come la crisi economica, i cambiamenti tecnologici o la ristrutturazione organizzativa dell’azienda. Questa pratica ha un impatto significativo sulla vita dei lavoratori affiliati, delle loro famiglie e della società in generale. Questa tesi mira a contribuire alla letteratura esistente sul licenziamento collettivo e a fornire una visione delle sfide affrontate dai lavoratori, dai datori di lavoro e dai politici nella gestione di questo processo complesso. Esploreremo il quadro giuridico e i requisiti procedurali che i datori di lavoro devono seguire quando decidono di attuare il licenziamento collettivo. Esaminando sia il punto di vista del dipendente che quello del datore di lavoro, questo lavoro mira a fornire una comprensione equilibrata del licenziamento collettivo, evidenziandone le conseguenze (tra cui disoccupazione, perdita di reddito, morale basso e impatto sulla comunità) e identificando potenziali strategie e migliori pratiche per la gestione del processo in modo equo e socialmente responsabile. Nel primo capitolo esamineremo le procedure e gli adempimenti che la repubblica italiana adotta in materia di licenziamenti collettivi ex legge 223\1991. Nell'ultima parte del capitolo saremo aiutati nella comprensione di questo fenomeno dalla giurisprudenza e in particolare dal caso Whirlpool di Napoli. Inoltre esamineremo, nel secondo capitolo, come questo fenomeno si è modellato nelle diverse legislazioni europee. L’Unione Europea (UE) ha svolto un ruolo fondamentale nel definire le politiche e le normative del lavoro nei suoi Stati membri, cercando di trovare un equilibrio tra la tutela dei diritti dei lavoratori e la promozione della competitività delle imprese. Attraverso un lavoro comparativo daremo uno sguardo alla regolamentazione dei licenziamenti collettivi in paesi come Spagna, Francia e Germania. Esaminando i casi europei di licenziamento collettivo spero di far luce sui punti di forza e di debolezza dell’attuale quadro giuridico e di suggerire possibili miglioramenti che potrebbero migliorare la tutela dei diritti dei lavoratori garantendo al tempo stesso la sostenibilità delle imprese in un’economia globale in rapido cambiamento. Infine, questa tesi discuterà il ruolo dei sindacati nella gestione dei licenziamenti collettivi. Esaminerà i quadri giuridici e politici che regolano il licenziamento collettivo e il ruolo dei sindacati nella protezione dei diritti e degli interessi dei dipendenti interessati. Comprendere il quadro giuridico relativo ai licenziamenti collettivi in Europa è fondamentale per comprendere i diritti e gli obblighi sia dei datori di lavoro che dei dipendenti in tempi così difficili.

From a legal standpoint, there are often specific regulations and procedures that employers must follow to ensure that collective dismissals are carried out in a fair and transparent manner, taking into account the rights and protections of affected employees. Additionally, ethical considerations, such as fairness, justice, and human dignity, play a crucial role in determining the moral implications of collective dismissal and the responsibilities of employers towards their employees. Collective dismissal, also known as mass layoff or redundancy, has become a common phenomenon in the modern workplace due to various reasons, such as economic turndowns, technological changes or company’s organisational restructuring. This practice has a significant impact on the lives of the affiliated workers, their families and the wider society. This thesis aims to contribute to the existing literature on collective dismissal and to provide an insight into the challenges faced by workers, employers and policy makers in managing this complex process. We will explore the legal framework and the procedural requirements that employers must follow when deciding to implement collective dismissal. By examining both the employee and employer perspectives, this work aims to provide a balanced understanding of collective dismissal, highlighting its consequences ( including unemployment, loss of income, reduced morale, and community impact) and identifying potential strategies and best practices for managing the process in a fair and socially responsible manner. In the fist chapter we will take a look into the procedures and requirements that the Italian republic adopts in regards to collective dismissals under Law 223\1991. In the last part of the chapter we will be helped in the understanding of this phenomenon by case law and in particular by the Whirlpool case in Naples. Additionally we will examine, in the second chapter, how this phenomenon was shaped in different European legislations. The European Union (EU) has played a pivotal role in shaping labour policies and regulations across its member states, seeking to strike a balance between protecting workers' rights and fostering business competitiveness. Through comparative work we will have a look at the regulation of collective dismissals in countries such as Spain, France and Germany. By examining the European cases of collective dismissal I hope to shed light on the strengths and weaknesses of the current legal framework and to suggest possible improvements that could enhance the protection of worker’s rights while ensuring the sustainability of businesses in a rapidly changing global economy. Finally, this thesis will discuss the role of labour unions in managing collective dismissal. It will examine the legal and policy frameworks that govern collective dismissal, and the role of labour unions in protecting the rights and interests of affected employees. Understanding the legal framework surrounding collective redundancies in Europe is crucial to comprehend the rights and obligations of both employers and employees during such challenging times.
