Il diritto di enfiteusi

Emphyteusis is a real estate which still exists in our legal system. Although the emphyteutic lease is outdated, it still exists nowadays. Some of these emphyteutic leases were established in ancient times (this kind of real estate can be perpetual), but there are also some emphyteusis established recently. Since the emphyteusis still exists, and there’s still litigation about it (especially about redemption and devolution) this topic deserves to be considered. In this dissertation the emphyteutic lease will be described and a recent ordinance of the Supreme Court about usucapion of this real estate will be studied. This dissertation is split into an introduction and three chapters. In the introduction, after a brief description of the history of emphyteusis, some specific cases of emphyteusis that either still exist or has recently terminated will be described. The first chapter is about the establishment of the emphyteusis. There, will be studied which way of establishment are suitable to set up that real estate. The second chapter concerns the rights and the obligation of the owner and the emphyteuta. The last chapter analyses the extinction of the emphyteusis.

L’enfiteusi è un diritto reale di godimento ancora presente nel nostro ordinamento giuridico. Nonostante il diritto di enfiteusi sia oggi pressoché desueto, esso non è scomparso completamente. Alcune delle enfiteusi attualmente esistenti sono state costituite in tempi antichi (tale diritto reale può essere costituito in perpetuo), ma non mancano casi di enfiteusi più recenti. Essendo il diritto di enfiteusi tutt’oggi esistente ed oggetto di contenzioso (soprattutto in materia di affrancazione e di devoluzione) esso merita ancora di essere studiato. In questa dissertazione verrà analizzato il diritto di enfiteusi e commentato un recente provvedimento della Corte di Cassazione avente ad oggetto l’acquisto per usucapione di tale diritto reale. La presente disertazione è suddivisa in un’introduzione e tre capitoli. Nell’introduzione, dopo aver ripercorso brevemente la storia dell’enfiteusi, verranno presi in considerazione alcuni casi concreti di tale diritto reale che sono ancora esistenti o si sono estinte recentemente. Il primo capitolo concerne la costituzione del diritto di enfiteusi. In quella sede verranno descritti i singoli modi con cui questo diritto reale può costituirsi. Nel secondo capitolo verranno trattati i diritti e gli obblighi del concedente e dell’enfiteuta. L’ultimo capitolo riguarda i modi di estinzione del diritto di enfiteusi.
