A Comparative View on Medical Negligence in Three Legal Systems

This dissertation scope is to provide a comparative view on medical negligence in three different legal systems, with the additional aim to provide data regarding the social and economic dimension of this phenomenon for a more wider view on the subject. This aim will be carried out by firstly analysing the main aspects of medical negligence in order to provide a clear view on the subject, while also enhancing the overall comprehensive of this paper as a whole. The economic and social dimension of medical negligence will be discussed through the analysis of the latest scientific medical data available on the matter while maintaining a comparative approach. The legal comparison will focus on the Italian, English and American legal systems, highlighting the potential difference and similarities that may arise between them. In particular, additional focus will be put on the legal nature of these systems, while also taking into account the structure of each national healthcare system. This legal analysis will be carried out by studying the individual parts of a lawsuit for medical negligence and how these steps are handled differently by each national legislations.
